1. Service Specific Terms
a. Subscription Plans
Subscriptions renew automatically unless canceled before the renewal date.Customers may cancel their subscription at any time; however, no prorated refunds are provided for partial billing periods.Cancellation requests will take effect at the end of the current billing cycle.
b. Set-Up Packages
Refunds are only available if requested before the onboarding call.Once the onboarding call is completed, no refunds will be processed, regardless of subscription cancellations, as customized work begins immediately after the call.
c. Software Transfers
A $250 fee applies to initiate the transfer process to alternate software platforms, including GoHighLevel.The transfer fee is waived for customers who have purchased a set-up plan from us, though limitations on transfer accuracy remain.We are not responsible for the accuracy, completeness, or successful execution of transfers, whether to or from GoHighLevel or other similar systems.Customers acknowledge that no program transfer guarantees 100% accuracy, even when facilitated by GoHighLevel itself.
2. Reasonable Expectations
While we aim to provide high-quality services, users understand and agree that:Technical issues or downtime may occasionally occur.Results from using our services depend on various factors, including user inputs, third-party integrations, and market conditions.Users are responsible for providing accurate and timely information to ensure optimal service delivery.
3. Limitations of Liability
The System Stack LLC is not liable for:Loss of data or errors during the transfer process to alternate platforms.Indirect, incidental, or consequential damages, including loss of business or revenue.Total liability for claims will not exceed the fees paid by the customer in the past six months.
4. Disclosures
Data Privacy: Customer data is handled in accordance with our Privacy Policy.Third-Party Tools: Services may integrate with third-party tools (e.g., Zapier, Stripe). We are not responsible for issues arising from these integrations.
5. Refund Policy
Subscriptions: Fees are non-refundable except as required by law.Set-Up Packages: Refund requests will not be processed after the onboarding call.
6. Additional Terms and Conditions
a. Force Majeure
The System Stack LLC is not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, cyberattacks, governmental actions, or utility failures.
b. Non-Solicitation Clause
Customers agree not to directly or indirectly solicit, hire, or engage any employee, contractor, or affiliate of The System Stack LLC during the term of service and for a period of one year following termination of the service.
c. Updates to Services
The System Stack LLC reserves the right to modify, suspend, or discontinue any service at its sole discretion, with reasonable notice provided to customers. Such updates are intended to improve functionality, ensure compliance, or adapt to market needs.
d. Termination Clause
We reserve the right to terminate access to our services for any reason, including but not limited to non-payment, violation of these terms, or misuse of the platform. Termination will include deactivation of customer accounts and loss of access to all services, data, and resources associated with the account.
